a. Full set of originals clean on board bill of loading, marked : “Freight prepaid”
b. Signed commercial invoice in 02 originals and 01 copy.
c. Signed detailed packing list in 02 originals and 01 copy.
d. Certificate of quality and quantity issued by manufacturer in 02 originals and 01 copy.
e. Certificate of origin issued by China Council for the promotion of international trade in 01 original and 02 copies.
f. Full set of insurance policy or certificate covering blank endorsed for 110 pct CIF value in the same currency of the draft, showing claims payable at Ho Chi Minh
covering all risks for the promotion of international trade in 01 original and 02 copies.
ARTICLE 4: CLAIM & PENALTY
g. All claims by the buyer shall be made by telex or fax within 10days after cargo arrives at Ho Chi Minh Port and shall be confirmed in written from sent to the seller within 30 days after receipt of survey report . In case of the shipment delay is occurred, 0.5% of interest per delayed day against contract value shall be imposed on the seller account but not exceed 5% of contracted amount.
- Quality/quantity discrepancy and claim:
In case of quality discrepancy, the Buyer may, within 15/30 days after the arrival of goods at the port of destination, lodge a claim against the Seller. The claim should be supported by reports issued by a recognized public surveyor approved by the Seller. While for Quantity discrepancy, the Buyer may, within 15 days after the arrival of the goods at the port of destination, lodge a claim against the Seller, and the Seller shall not be liable for any discrepancy attributable to the insurance company, shipping company and other transportation organization or post office....
